The Nuclear Regulatory Commission (NRC) is moving forward on its rulemaking to expand the definition of byproduct material as part of the implementation of Section 651(e) of the Energy Policy Act of 2005.
A draft final rule was forwarded to the commission on April 3, 2007, in a commission paper [SECY-07-0062, Final Rule: Requirements for Expanded Definition of Byproduct Material (RIN: 3150-AH84)]. The NRC is making the commission paper and its enclosures of the draft final rule publicly available to keep stakeholders informed.
The commission is currently reviewing the draft final rule package and will be voting on it at a later date. Therefore, the draft final rule package, including the draft Federal Register notice, only represents the staff's recommendation. The commission may change the content of the final rule before publication.

The NRC is not soliciting comments on the draft final rule package. Once the commission approves the final rule, and the OMB approves the information collection requirements, the final rule will then be published in the Federal Register. The rule will become effective 60 days from the date of publication in the Federal Register.
