No property removed until fully paid. All equipment is sold as is and where is. The information contained in this listing is subject to inspection and verification by all parties relying on it. No liability for its accuracy, errors, or omissions is assumed by the seller, the representative of the seller, PremierMedicalDepot or their agents.

All property is sold 'AS IS', and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. PremierMedicalDepot may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall PremierMedicalDepot be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value.

Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. PremierMedicalDepot shall endeavor to describe in detail each item and any pertinent information about it.

PremierMedicalDepot will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase.

The Bidder agrees that the seller, any representatives of the seller, PremierMedicalDepot or their agents shall not be held responsible or liable:

* for any injuries or damages, whether incidental or consequential, associated in any way with the equipment;

* for compliance with regulations on ownership or use of the purchased item within the jurisdiction in which the purchaser resides and/or uses the item.

The sale of this item may be subject to regulation by Health Canada, the U.S. Food and Drug Administration and other national/provincial/territorial/state and local regulatory agencies. If so, do not buy this item unless you are an authorized purchaser. If the item is subject to Health Canada or FDA regulation and it is to be used for regulated medical services in Canada or the USA, your payment for it indicates you are an authorized purchaser and will comply with these regulations. If you have questions about legal obligations regarding sales of medical devices, you should consult with Health Canada, the FDA or the regulatory authorities in the jurisdiction in which the item is to be used.

Payment Instructions:

PLEASE EMAIL auctionservices@Premiermedicaldepot.com with any questions on these instructions. All sales are FOB origin and title transfers to Buyer upon payment. Invoices will be sent 24-48 hours after the auction closes. The credit card a winning bidder has on file with DOTmed will be charged after the auction closes within 48 hours. If the credit card on file with DOTmed is insufficient Buyer must make alternative arrangements to pay within 72 hours of auction close. 3% payment processing fee applied to credit card transactions. To avoid sales taxes, Buyer must send documentation of tax-exempt status auctionservices@Premiermedicaldepot.com within twelve (12) hours of an Auction closing

Taxes:

Taxes arising from the sale of Equipment will be charged to Buyer and will be added to the purchase price per local, state, and/or federal laws, and the Buyer will also bear the cost of any personal property taxes assessable on the Equipment after delivery to a carrier. To avoid being charged sales taxes, the Buyer must send appropriate notice and documentation of tax-exempt status to auctionservices@Premiermedicaldepot.com no later than twelve (12) hours after the end of any Auction. Upon acceptance of a Winning Bid and closing of a lot or Auction, Premier Medical Auctions will automatically charge the credit card Buyer has on file with DOTmed.com for the amount of any Winning Bid plus all applicable taxes as described above within 48 hours.

When using this credit card or any other credit card or payment processing service including, but not limited to PayPal, Premier Medical Auctions will add a processing fee equal to three percent (3%) of the total amount of the charge. If all or part of any amount owed by a Buyer cannot be charged to the credit card on file with DOTmed, Premier Medical Auctions will notify the Buyer to make alternative payment arrangements for amounts still owed. Alternative payment must be made within 72 hours after the close of any Auction. If alternative payments are not made within 72 hours of the close of any Auction then Premier Medical Auctions, at its sole discretion can pursue collecting the amount owed from Buyer and otherwise resell or dispose of the Equipment.

Equipment Pickup And Shipping.:

Equipment from Winning Bids can be picked up beginning the first business day after any Auction closes. In all cases Equipment from Winning Bids must be picked up no later than ten (10) business days after the close of any Auction. Any Equipment not picked up within that timeframe may, at Premier Medical Auctions sole discretion, be considered forfeited by Buyer and resold or disposed of by Premier Medical Auctions however Premier Medical Auctions sees fit.

Unless noted on an Equipment listing, all pickups will take place at 2817 Broadway Ct, Edmond OK 73013 Buyer is responsible for all costs associated with packing, pickup, loading, and shipping of Equipment from their Winning Bids. Buyer is also responsible for arranging for packaging, pickup, and shipping of their Equipment during Monday Friday between the hours of 8:00 AM and 4:00 PM Central Time, excluding holidays.

To schedule a specific pickup Buyer may contact Premier Medical Auctions at auctionservices@Premiermedicaldeot.com or (405) 365-5401. Equipment will not be released to a Buyer or Buyers representative unless the invoice has been paid in full. The buyer must notify Premier Medical Auctions if he/she is not picking up in person and must provide Premier Medical Auctions with the representatives' Full Name or Company Name. Buyer or Buyers representative must present the invoice and proper identification for equipment to be released I.E. Paid In Full Invoice. Once Equipment is turned over to Buyer or Buyers representative the Buyer is responsible for all insurance of, and loss, or damage to Equipment. Premier Medical Auctions makes no warranty and takes no responsibility or liability for Equipment lost or damaged from the time Buyer or Buyers representative is given access to the equipment. Buyers may pick up equipment themselves, use their own carriers or contact the following companies to provide pickup, packaging, and shipping services on their behalf:

UPS Store (small package and non-freight items) For $30.00 we can deliver your items for you to the UPS Store # 3126 S Blvd, Edmond, OK 73013 (405) 348-0334, and they can pack and ship your items for you.

Premier Medical Auctions Medical also offers optional packaging and shipping coordination services. Just email shipping@premiermedicalauctions.com for a shipping quote. Applicable sales taxes will be added to the cost of these services per local, state, and/or federal laws.

Buyer bears all freight, handling, and processing costs and Buyer owns goods in transit regardless of whether Buyer asked Premier Medical Auctions to provide packing or shipping services or not. Premier Medical Auctions is not liable for any loss, damage, expense, or charge of any kind resulting from a delay in shipment or delivery. Delivery to Buyer shall be deemed complete and risk of loss or damage for products shall pass to Buyer upon transfer of goods to Buyer, Buyers designated representative, or any private or a common carrier regardless of whether Buyer asked Premier Medical Auctions to provide packing or shipping coordination services. Export, Import, And Other Regulations. Buyer assumes all responsibility for compliance with all laws and regulations of the United States and any other country from which Buyer may access an Auction or purchase or ship Equipment to or from regarding Buyers access, use, export, re-export and/or import of any content or Equipment accessed or purchased through an Auction. Buyer acknowledges and agrees that Buyer will not export or import any Auction content or Equipment to any country to which export or import is restricted under United States law, that Buyer is not a national of any such country, and that the Auction content and Equipment Buyer purchases will not be used in the design, development or production of nuclear, chemical or biological weapons.

Premier Medical Auctions may, at its sole discretion and for any reason, refuse to accept any bid made during an Auction, choose to remove any Equipment from any Auction at any time before the completion of the Auction even if bidding has taken place on that Equipment, or cancel or terminate any Auction that has been announced or is underway.

Warranty Disclaimer.
EQUIPMENT (AS SUCH TERM IS DEFINED IN THIS AGREEMENT) AND ANY OTHER SERVICES, DATA, MATERIALS, AND CONTENT (ACCOMPANYING AND/ OR EMBEDDED WITHIN EQUIPMENT) IS PROVIDED AS IS, IRRESPECTIVE OF CONDITION, WEAR, DAMAGE, AND AS AVAILABLE, WITH ALL FAULTS, DEFECTS, AND WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED BY PREMIER MEDICAL AUCTIONS, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, USE, QUIET ENJOYMENT, QUALITY, QUALITY OF INFORMATION, CAPACITY, DESIGN, WORKMANSHIP, AND TITLE/NONINFRINGEMENT. BUYER ASSUMES TOTAL RESPONSIBILITY AND RISK FOR ANY AND ALL USE OF EQUIPMENT. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY PREMIER MEDICAL AUCTIONS OR ITS AUTHORIZED REPRESENTATIVES SHALL CREATE A WARRANTY, EQUIPMENT ENDORSEMENTS OR MEDICAL ADVICE, OR IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY OR THE OBLIGATIONS OF PREMIER MEDICAL AUCTIONS. THE AVAILABILITY OF EQUIPMENT FOR PURCHASE FROM PREMIER MEDICAL AUCTIONS IN NO WAY CONSTITUTES AN ENDORSEMENT OF SUCH BY PREMIER MEDICAL AUCTIONS, NOR ANY REPRESENTATION OR WARRANTY AS TO THE SAFETY, EFFICACY OR APPROPRIATENESS OF ANY EQUIPMENT. PREMIER MEDICAL AUCTIONS PROVIDES NO PROFESSIONAL OR MEDICAL ADVICE AS TO ANY EQUIPMENT OR USE OF EQUIPMENT. BUYER EXPRESSLY AGREES AND ACKNOWLEDGES THAT PURCHASE, USE OF AND RECEIPT OF EQUIPMENT IS AT BUYERS SOLE RISK.


Limitation of Liability.
If any Equipment from a Winning Bid is not available for pickup or delivery to Buyer for any reason, Premier Medical Auctions liability shall be limited to a credit or refund of any monies Buyer may have paid for such Equipment that is not deliverable. Notwithstanding anything to the contrary herein, Premier Medical Auctions shall not be liable for any delay in delivery or for non-delivery of Equipment in whole or in part caused by the occurrence of any contingency beyond Premier Medical Auctions control including, but not limited to, war, sabotage, acts of civil disobedience, failure or delay in transportation, an act of any government or agency for subdivision thereof, judicial action, labor dispute, fire, accident, explosion, quarantine, restrictions, storms, flood, earthquake, or acts of God, shortage of labor, fuel, raw materials, or machinery or technical failure where Premier Medical Auctions has exercised ordinary care in the prevention thereof. If any contingency occurs, allocation of Equipment and delivery thereof will be at Premier Medical Auctions discretion.
